End-user licence agreement

1. The agreement

This End-User Licence Agreement ("EULA", "Agreement") is between you and Casinowise Ltd ("we", "us", "our") and governs your download, installation and use of the CasinoWise application, together with any updates, content and documentation provided with it (the "Application").

By downloading, installing or using the Application you accept this Agreement. If you do not accept it, do not install or use the Application.

The Terms and Conditions govern your wider use of the Service, and the Privacy Policy describes how information is handled.

2. Purpose of the app

CasinoWise is an educational field guide and trainer for casino games. It reports the house edge, return to player and bet-level edges for 24 games, explains how each game plays, provides twelve written guides and a glossary, and offers four practice drills that check your decisions against the correct play and give the reason.

The Application does not provide real-money gambling. It does not:

• accept wagers, bets or deposits;
• permit withdrawals or cash-outs;
• award cash, prizes, cryptocurrency or anything redeemable;
• operate a purchasable or redeemable virtual currency;
• offer chips, coins, credits or tokens for purchase or play; or
• provide anything of monetary value based on an outcome.

Card, dice, wheel and table imagery appears as the subject of the guide. It is not a game of chance you can play for anything, and there is no balance to lose.

3. Licence grant

Subject to this Agreement we grant you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and use the Application on an Apple-branded device that you own or control, for your own personal, lawful, non-commercial use.

The Application is licensed, not sold. No ownership of the Application or of any intellectual property in it passes to you, and all rights not expressly granted are reserved.

4. Eligibility

You must be at least 18 years old to use the Application, or older where the law of your country requires a higher age for content of this kind. The Application asks you to confirm your age before any content is shown.

By using the Application you confirm that you meet the applicable age, that you have the legal capacity to accept this Agreement, and that your use is lawful where you are. The Application is not directed to children.

5. No real-money gambling

You cannot use the Application to place a real-money bet or wager, to deposit or withdraw money, to receive winnings or prizes, to exchange any result for money or property, or to take part in real-money gambling of any kind. The Application is not a gambling operator, casino, sportsbook, lottery, payment service or financial platform.

No figure, drill result, accuracy record or saved item in the Application has any monetary value, and none creates an entitlement against us.

6. Restrictions

Except where the law expressly permits it, you must not:

• copy, reproduce, distribute, sell, rent, lease or sublicense the Application;
• modify, adapt or translate it, or create derivative works from it;
• reverse engineer, decompile or disassemble it, or attempt to derive its source code;
• remove or obscure any copyright, trademark or other proprietary notice;
• bypass any technical protection, authentication or access control;
• use it to break the law, to distribute malware, or to interfere with any system or network; or
• present its content as advice given to a particular person by us.

7. Ownership

The Application and its original elements — the software, the interface and its design, the written guides, the game descriptions and figures, the illustrations, the card deck, the CasinoWise name and marks and the selection and arrangement of the content — are owned by or licensed to Casinowise Ltd and protected by copyright, trademark and other laws. Third-party components remain the property of their respective owners and are governed by their own licences.

8. Updates and compatibility

We may release updates that fix errors, improve performance, change features or address security. Some updates may be installed automatically according to your device settings, and continued use may require them. We do not guarantee that any particular feature or earlier version remains available.

The Application requires an iPhone running iOS 16 or later. It is a portrait-only iPhone application and also runs in the compatibility window on an iPad. Changes made by Apple to iOS or to the App Store may affect how it behaves, and we do not guarantee compatibility with every device or system version.

9. No purchase required

The Application is free. It contains no subscription, no in-app purchase, no advertising and no virtual currency. If paid functionality is ever introduced, it will be disclosed before purchase and governed by additional terms presented at that time.

10. Support

Support is provided by us, not by Apple, at contact@casinowiseapp.com. We decide the kinds of support we offer and the versions we support. We are not obliged to support outdated versions indefinitely.

11. Privacy and device data

What the Application records — bookmarks, drill records, your age confirmation, your text-size choice — is stored in the Application's own storage on your device. It is not sent to us. The full description is in the Privacy Policy.

You may request deletion of any personal information we hold about you by writing to contact@casinowiseapp.com. Because there is no account, there is no account to delete; information on your device is removed when you clear it in Settings or delete the Application.

12. Apple App Store terms

If you obtained the Application through the Apple App Store, the following applies. You acknowledge that this Agreement is between you and Casinowise Ltd, and not with Apple Inc. ("Apple"). Casinowise Ltd, not Apple, is responsible for the Application and its content.

The licence granted to you is limited to a non-transferable licence to use the Application on Apple-branded products that you own or control, subject to the applicable Apple Media Services Terms and any permitted family-sharing arrangements.

• Apple has no obligation to provide maintenance or support services for the Application.
• Casinowise Ltd, not Apple, is responsible for addressing any claim relating to the Application.
• Casinowise Ltd, not Apple, is responsible for investigating any claim that the Application infringes a third party's intellectual property.
• Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it.

Nothing in this Agreement limits rights that cannot lawfully be limited under Apple's terms or applicable consumer law.

13. Technical malfunctions

The Application may occasionally crash, freeze, fail to load, or display a figure or a card incorrectly. Because the Application involves no money, no stake and no redeemable value, a malfunction creates no entitlement to compensation, credit, a prize or any other payment. We may correct, reset or remove defective content. If a drill behaves oddly, tell us and we will fix it.

14. No warranty

To the maximum extent the law permits, the Application is provided "as is" and "as available", and we disclaim all express, implied and statutory warranties, including merchantability, fitness for a particular purpose, accuracy, reliability and non-infringement.

We do not warrant that the Application will be error-free, that it will run on every device, or that every figure will match the rules of every table. Mandatory consumer warranties are unaffected.

15. Limitation of liability

To the maximum extent the law permits, Casinowise Ltd is not liable for indirect, incidental, special, consequential or punitive loss arising from the Application, including loss of data stored on your device, loss of use, or reliance on its content.

Our total liability under this Agreement will not exceed the greater of the amount you paid us for the Application in the twelve months before the event, or the minimum amount the law requires. Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be excluded.

16. Termination

You may end this Agreement at any time by deleting the Application from your device. We may end your licence if you materially breach this Agreement, if the law requires it, or if we discontinue the Application. Provisions that by their nature should survive — ownership, disclaimers, liability and governing law — do survive.

17. Governing law

This Agreement is governed by the laws of the jurisdiction in which Casinowise Ltd is established, without regard to conflict-of-law principles, except where mandatory consumer law gives you the protection of the law of your own country of residence.

This Agreement is published in English. If it is translated, the English version controls to the extent the law allows.
